Partner David Donahue co-authored the Supreme Court of the U.S. brief submitted by the International Trademark Association (INTA) as amicus curiae in Iancu v. Brunetti. INTA’s brief argues that Section 2(a) of the U.S. Trademark (Lanham) Act is unconstitutional under the First Amendment to the extent it prohibits registration of trademarks that constitute “immoral … or scandalous matter.”
