Law360 Speaks to Richard Z. Lehv About the Biggest Trademark Decisions in 2023 So Far

Richard Z. Lehv was quoted in Law360‘s article “The Biggest Trademark Decisions Of 2023: A Midyear Report” regarding the case of Abitron Austria GmbH et al. v. Hetronic International Inc. This June decision by the Supreme Court invalidated a $96 million award against Hetronic Germany and its affiliates. Authored by Justice Samuel Alito, the decision clarified that the Lanham Act’s provisions on trademark infringement do not extend beyond U.S. borders and apply only to instances where the infringing use occurs within the United States.

In speaking with Law360, Richard emphasized the significance of this ruling. He noted that this “confirms that under U.S. law, there’s a presumption against extraterritorial application of U.S. statutes.”
